  • Underage drinking: On a first offense, a citation for underage consumption of alcohol carries a three-month driver’s license suspension, whether or not the person was in a car at the time. On a second offense, the suspension is one year.
  • Underage DUI: Drivers under the age of 21 can be charged with driving under the influence at a BAC of .02 or greater ( any alcohol in the blood). Enhanced penalties apply at BAC levels of .10 and .16.
  • Furnishing alcohol to a minor: This is a jailable misdemeanor, and can apply to college students who are over the age of 21 and provide liquor to their underage friends or parents who provide alcohol for an at-home party. Additional criminal charges and civil liability are possible if the underage drinker injured someone while driving.
  • Other alcohol offenses: Other alcohol offenses include public drunkenness, open container, or attempting to purchase liquor by a person under the age of 21.
