The Laws Are Much Tougher On Repeat Offenders

Under the old law, the “look back” for DUI/DWI was seven years. Pennsylvania law now considers any drunk driving conviction within 10 years as a prior offense, and the penalties are brutal.

  • Repeat DUI — If your blood alcohol content (BAC) is .16 or higher on your second offense, a conviction carries a statutory minimum of 90 days in jail. After the mandatory 18-month license suspension, you will be required to install and use an ignition interlock device on your vehicle at your own expense for one year. This scenario is for a first-degree misdemeanor, with a parole tail of five years — if you commit any criminal offense in that time, you can be resentenced to additional jail time.
  • Third-offense DUI — Say a person had two DUIs in a short span (a common scenario), got his life together but was pulled over nine years later on suspicion of driving under the influence. Under the new law, a conviction for your third DUI (High BAC .10 to .159) could carry a mandatory sentence of a year in state prison.
  • DUI homicide — Causing a death while driving under the influence of alcohol or drugs is a serious felony. It carries a mandatory minimum prison sentence of at least three years, and maybe more depending on BAC and prior convictions.
